CHAPTER 19

Chapter 19 is the section in the Department of Education Title 8 legislation that covers student misconduct, discipline, search and seizures, police interviews and arrests, restitution for vandalism and negligence. Kealakehe's official Student Discipline Plan, approved by SCBM in June, 2000, conforms to Chapter 19, as well as our own guidelines. Listed below is a summary of our school discipline plan, as it relates to Chapter 19.

"Class A"
(Illegal in Hawaii)
  • Assault
  • Alcohol
  • Burglary
  • Dangerous Weapon
  • Drug Paraphernalia
  • Extortion
  • Firearms
  • Illicit Substances
  • Marijuana or concentrate
  • Murder
  • Property Damage
  • Robbery
  • Sexual Offenses
  • Terroristic Threatening

Possible Consequences:
Arrest. This depends on the determination of the HPD.
1st Offense: Suspension from 3 - 45 days and/or Serious Discipline
2nd Offense: Suspension from 5- 45 days and/or Serious Discipline
3rd Offense: Serious Discipline
(Serious discipline can include expulsion from school for the rest of the year, disciplinary transfer, or other defined actions under Chapter 19)

"Class B"
(Illegal in Hawaii)

Consequences:
May vary according to the severity and frequency of the violation. Aside from arrest (depends on HPD investigation), consequences may range from:

• Parent contact
• Counseling
• Reprimand
• Confiscation
• Detention
• All-day detention
• Suspension
• Expulsion

 

"Class C"
(Forbidden by DOE)

  • Cutting Class
  • Insubordination
  • Laser/Light Pen
  • Leaving Campus Without Permission
  • Smoking or Tobacco Use
  • Truancy

Consequences:
May vary according to the severity and frequency of the violation. Consequences may range from:

• Parent contact
• Counseling
• Reprimand
• Confiscation
• Detention
• All-day detention
• Suspension
• Expulsion

"Class D "
(Forbidden by KIS)

  • Contraband
  • Disrespect/Noncompliance
  • Dress Code
  • Inappropriate Language
  • Lying and/or Cheating
  • Physical Contact
  • Property Misuse
  • Teasing and Taunting
  • Other
